Mystery Circle Renegade Tour Drawing Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT

INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: The Mystery Circle Tour Drawing (the "Promotion") is open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least seventeen (17) years old at the time of entry, and who are official members of the Renegade Fashion Social Network, and the Jared Gold Mystery Circle™. Employees of Jared Gold, Inc, and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and all of the Administrator's decisions, which are final and binding in all matters related to the promotion which consists of a drawing where an entrant is selected to travel as a member of the Jared Gold Runway Show during the upcoming Renegade Fashion Tour.

2. Offefor: Jared Gold, Inc, Hollywood, CA 90026 Administrator: FNC Events, Inc. PO Box 1175 Orem, UT 84057 shall administrate the awarding of the random drawing and deliver the winner to Mr. Jared Gold, who will make the formal announcement. The decisions of these two entities are absolute and final.

3. Timing: The Promotion begins on July 13, 2009 at 12:00 a.m. Eastern Time ("ET") and ends on September 3, 2009 at 11:59 p.m. ET (the "Promotion Period"). Administrator's computer is the official time keeping device for this Promotion.

4. How to Enter: During the Promotion Period, eligibile members must go to the Official Mystery Circle Member’s page and click the entry link. Entries will be accepted throughout the promotion period free of charge. There is only one entry per person, however, Mr. Gold’s Golden Tickets will be redeemable for additional entries, and Mystery Circle members may obtain additional Golden Tickets, (also redeemable in the Jared Gold online members store) by asking friends to join the network and donate to the American Artisan Foundation. By being in Jared’s Magic Circle (his personal fan club) one ticket is awarded allowing one opportunity to participate by receiving a ticket, redeemable for merchandise, or in the A ticket will be awarded for every 5 individuals brought to Jared’s Magic Circle Fan Club who donate to the AAF. Tickets do not have to be used for multiple entries, but can also be applied to other merchandise in the Jared Gold Store, or presented for preferred seating when available. You must also be a member of Jared Gold’s Social Network, JaredGoldRenegadeFashion.org to participate, and therefore have access to an internet connection. Many libraries have access to computers free of charge to the public, and Jared Gold, Inc. encourages those without a valid internet connection wishing to participate to use those resources. The Administrator is responsible for the collection of the entrants names, which are date stamped and identified as to the IP origin. Limit: Each participant may enter one (1) time per day during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Offeror, and/or administrator is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, golden tickets or unfounded claims without proper registration and documentation. In the event of a dispute the authorized account holder of the email address used to register will be deemed to be the registrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Tour awardees may be required to show proof of being the authorized account holder.   

5. Terms: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER UNLESS AND UNTIL THE ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. OFFEROR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.

6. Verification of Potential Awardees: Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by mail, email or phone. If a potential winner of any donation prize cannot be contacted, the awardee forfeits the tour spot. In the event that a potential winner is disqualified for any reason, The Offeror will award the spot on the Tour to an alternate winner by random drawing from among all remaining eligible entries. There will be three (3) alternate drawings after which the donation will remain unawarded. Filled tour spots will be announced at the end of the Promotion, at the discretion of the Offeror.

7. Awards. ONE (1) WINNER A spot on the Jared gold Renegade Tour Working in any capacity as one of the crew. Instant Win Awards: TWENTY (20) OFFICIAL TOUR RENGADE TEES: (1) Tee Shirt Prize per person. For All Donation Prizes: Offeror will present the award and be notified by email, mail or phone. Each award recipient will be required to sign all documents required by Offeror in order to accept the Award. No exceptions. Awardees are responsible for all federal, state and local taxes and any other costs, expenses and fees associated with the award. Upon receiving notification, Awardee will be given a detailed manifest of expenses included, if any. If the Awardee declines the Tour spot for any reason, the second draw shall be given the Award. By accepting the Award, the individual must agree to the use of their name, location, trademarks, logos, photograph, and/or image in any and all media now or hereafter known, worldwide and on the Internet and in perpetuity by Offeror and its designees, without compensation (unless prohibited by law) or additional consents from such organization or its authorized representatives or any third party and without prior notice, approval or inspection, and to execute specific consent to use if asked to do so. All contribution details are at Offerror’s sole discretion. All donations are non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion.

8. Release: By participating, each entrant agrees to release and hold harmless Jared Gold, and Fullnelson, Inc. and their owners, families and assigns, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion, Tour, or receipt or use or misuse of any donation.

9. Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

10. General Conditions: Offeror reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Offeror’s reasonable control impairs the integrity or proper functioning of the Sweepstakes or Instant Win Game, as determined by Sponsor in its sole discretion. In such event, Offeror reserves the right to distribute awards at random from among the eligible entries received up to the time of the impairment. Offeror reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Tour award selection process or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Tour Award may be a violation of criminal and civil law, and, should such an attempt be made, Offeror reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any award, or accident or injury. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Offeror, at his discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the donation prizes offered herein. No more than the stated number of donations will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of donations as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of donation prizes by a random drawing among all legitimate, un awarded, eligible prize claims.

12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Award shall be resolved individually, without resort to any form of class action, having first sought mediation. limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Offeror in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.

13. Entrant's Personal Information: Information collected from entrants shall be subject to our standard terms and privacy agreements. Please read and mark the appropriate boxes as “in agreement” on both documents.

We (the owners, offerors and administrators) reserve the right to change these rules at any time and without notice. Any participant agrees to this without reservation or exception.
